Employers in Montana are permitted or required to conduct criminal record checks in accordance with these rules.

Criminal records checks are required for employment in facilities caring for the elderly and the developmentally disabled and for teachers before being hired to work in Montana schools.

Applicants for licensing as security companies, security guards, and private investigators must submit evidence under oath of not being convicted of certain crimes, and being otherwise fit. The license application must also include two sets of fingerprints.
