Employers in Hawaii are subject to these state rules that restrict firing employees under certain circumstances.

Hawaii laws make it unlawful for an employer to:

  • require an employee to take a polygraph test
  • fire an employee who refuses to work in unsafe conditions
  • fail to allow employees time off to vote
  • fail to allow employees to respond to a summons or to be a witness
  • fail to pay employees for serving on jury duty
  • fire for union activity
  • deny equal employment opportunity
  • violate protections for reservists or veterans
  • retaliate against an employee for filing a safety complaint, reporting a violation of law, or filing a wage claim
  • fire an employee for having wages garnished
  • fire an employee for using family leave
