California Nursing in the Workplace Rules

California employers must comply with these state rules regarding nursing in the workplace.

A mother may not be prohibited from breastfeeding her child in any location, public or private, except the private home or residence of another, where the mother and the child are otherwise authorized to be.

Employers must provide a reasonable amount of break time to accommodate employees desiring to express breast milk for their infant child.

The break time should, if possible, run concurrently with break time already provided to the employee. Break time that doesn't run concurrently with rest time authorized by applicable orders of the Industrial Welfare Commission is unpaid.

Employers must make reasonable efforts to provide employees with the use of a room or other location other than a toilet stall, in close proximity to the work area, to express milk in private.

Employers are not required to provide break time for expressing breast milk if to do so would seriously disrupt the operations of the employer.
