Drug testing by employers in Texas is governed by these state rules.
Texas law does not contain a general provision related to mandatory drug and alcohol testing but testing for specific occupations (for example, employees of nursing homes) is required.
Employers with 15 or more employees who have workers' compensation insurance coverage must adopt a policy designed to eliminate drug abuse and its effects in the workplace. Employers must distribute a written copy of the policy to each employee.
