Hawaii employers must comply with these state rules regarding nursing in the workplace.
Effective July 1, 2013, employers are required to provide a reasonable break time for an employee to express breast milk for the employee’s nursing child, as needed, for up to one year after the birth of the child. Employers must provide employees with a private location, other than a restroom, to express breast milk.
The breastfeeding accommodation law does not apply to employers with fewer than 20 employees if the employer can show that the requirements would impose an undue hardship by causing the employer significant expense in relation to the size, financial resources, nature, or structure of the employer’s business.
Employers must post a notice in a conspicuous place accessible to employees and must keep employees informed of these protections and obligations.
