South Dakota employers must provide employees with leave for jury duty in accordance with these state rules.
South Dakota law provides that it is unlawful to discharge or suspend an employee because of jury service.
The temporary leave of absence while performing jury duty may be with or without pay at the discretion of the employer.
Any employee serving as a juror must retain and be entitled to the same job status, pay, and seniority as he had prior to performing jury duty.
