Minnesota Nursing in the Workplace Rules

Minnesota employers must comply with these state rules regarding nursing in the workplace.

Employers may not prevent a nursing mother from taking reasonable unpaid break time each day to express breast milk for her infant child and must provide a reasonable amount of break time each day to an employee who needs to express breast milk for her infant child.

The break time must, if possible, run concurrently with break time already provided. However, employers are not required to provide break time for expressing breast milk if to do so would unduly disrupt the operations of the employer.

Employers must make reasonable efforts to provide a room or other location other than a toilet stall, in close proximity to the work area, where the employee can express her milk in privacy. Employers are held harmless if reasonable effort has been made.
