Ohio Overtime Pay Law

Employers in Ohio must conform with these state rules regarding overtime pay for employees.

In Ohio, overtime of one and one-half times an employee's regular rate must be paid for all hours over 40 in one workweek, in the manner and methods provided in and subject to the exemptions of federal wage-hour law.

Exemptions From the General Overtime Provision

The following are exempt from the overtime provisions:

  • babysitters and live-in companions whose principal duties do not include housekeeping
  • newspaper delivery persons
  • outside salespersons compensated by commissions or in a bona fide executive, administrative, or professional capacity
  • certain agricultural employees
  • members of the employer's immediate family
  • volunteers in a hospital or health institution
  • employees of a camp or recreational area for children under 18 years of age, owned and operated by a nonprofit
