Paying Terminated Employees in Hawaii

Employers in Hawaii must comply with these state requirements when making the final wage payment to terminated employees.

In Hawaii, discharged employees must be paid at discharge, unless it occurs at a time and under conditions that prevent employer from making immediate payment; then not later than the next working day.

Employers requiring advance notice of termination are liable for the wages that the employee would have earned during the period stated in the notice, starting from the day the notice is given, if the employee has not voluntarily terminated his employment during the period or been terminated for cause.

Employees who quit must be paid no later than the next regular payday (if employee gives at least one pay period's notice, payment is due at time of quitting), either through regular pay channels or by mail, if requested by employee.

Striking or laid-off employees must be paid by next regular payday, by regular pay channels or by mail.
