Restrictions on Firing Employees in Montana

Employers in Montana are subject to these state rules that restrict firing employees under certain circumstances.

Montana laws make it unlawful for an employer to:

  • fire an employee in retaliation for reporting a violation by the employer
  • fire an employee for other than good cause after the employee has completed a probationary period
  • fire an employee in violation of the employer's own written personnel policies
  • require an employee or applicant to take a polygraph test
  • deny equal employment opportunity
  • fire an employee for having wages withheld for child support or other garnishment
