Using Lie Detector Tests in Oregon

The use of lie detector tests by employers in Oregon is subject to these state rules.

An Oregon employer may not require, as a condition for employment or continuation of employment, that a person or employee take a polygraph test or any other form of a lie detector test.

It is an unlawful employment practice for an employer to subject, directly or indirectly, an employee or prospective employee to a polygraph examination or psychological stress test.

A polygraph examination may be administered to an individual:

  • if the individual consents to the examination
  • during the course of criminal or civil judicial proceedings in which the individual is a party or witness
  • during the course of a criminal investigation conducted by a law enforcement agency, a district attorney or the Attorney General
