Workplace Smoking Rules in Nebraska

Employers in Nebraska must comply with these state rules regulating smoking in the workplace.

The Nebraska Clean Air Act prohibits smoking in a place of employment or a public place.

No smoking areas: Smoking is prohibited in a public place or a place of employment. Public areas are any enclosed, indoor areas used by the general public or serving as a place of work.

A private residence is a place of employment when the residence is being used as a licensed child care program and one or more children who are not occupants of the residence are present.

Permitted smoking areas: The following areas are exempt from the Nebraska Clean Indoor Air Act:

  • guest rooms and suites that are rented to guests and are designated as smoking rooms, except that not more than 20 percent of rooms rented to guests in an establishment may be designated as smoking rooms, and all smoking rooms on the same floor must be contiguous, and smoke from these rooms must not infiltrate into areas where smoking is prohibited by the Nebraska Clean Indoor Air Act
  • indoor areas used in connection with a research study on the health effects of smoking conducted in a scientific or analytical laboratory under state or federal law or at a college or university approved by the Coordinating Commission for Postsecondary Education
  • tobacco retail outlets
  • cigar bars
